1. Handmade Product Variance & Intellectual Property

  • Handmade Nature: Every item sold through Sam's Handcrafted Pens is individually turned and finished by hand. Due to the natural variations in timber grain, acrylic patterns, and the artisanal process, no two pens are identical. Small variations in color, texture, and finish are unique characteristics of handmade goods and do not constitute product defects.

  • Intellectual Property: All content on this website—including text, graphics, logos, product designs, video content, and images (including markings related to "CMC" and "Corrupted Pens")—is the intellectual property of Samuel Stegemann. You may not copy, reproduce, or distribute any content or designs without express written permission.

2. Ordering, Pricing, & Batches

  • Availability: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. As items are crafted in batches, availability may fluctuate, and we reserve the right to discontinue any product at any time.

  • Price Changes: Prices for our products are subject to change without notice.

  • Contract of Sale: An order placement constitutes an offer to purchase. We reserve the right to refuse or cancel any order (for example, due to stock limitations or suspected fraudulent activity). If an order is canceled after payment, a full refund will be issued immediately.

3. Australian Consumer Law (ACL) Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

 

  • You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

     

  • You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Because these are bespoke, handmade items, minor cosmetic variations inherent to natural wood or handcrafted production do not constitute a failure of consumer guarantees.

4. Limitation of Liability

  • To the maximum extent permitted by law, Sam's Handcrafted Pens, its owner, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use of, or the inability to use, our products or website.

  • We do not guarantee that standard postal delivery windows will always be met. As stated in our Shipping Policy, tracking numbers are not provided, and we are not liable for standard transit delays caused by third-party postal services.

5. Governing Law

These terms, your use of this website, and any purchase agreements made through the store are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Queensland.

We reserve the right to update, change, or replace any part of these Legal Notices by posting updates to our website. It is your responsibility to check this page periodically for changes.
